North Carolina's lawsuit against the Tennessee Valley Authority over air pollution is likely to cost the state more than $5 million in legal expenses, state Attorney General Roy Cooper said today.
The state so far has incurred $3.5 million in legal expenses in its quest to get the TVA to reduce the amount of pollutants released from its coal-fired power plants, Cooper said. If the case goes to court, he said, costs will rise by $1.9 million.

... much of the legal expense goes for experts who have quantified the health risk and economic loss to North Carolina. He said he has several in-house lawyers working on the case and plans to seek reimbursement of legal expenses from the TVA if the state wins the case.

The TVA operates 11 coal-fired power plants in Tennessee, Alabama and Kentucky. Officials there say that the TVA is complying with federal clean air laws and has spent $4.6 billion over the past 30 years to reduce pollution.
